A surprise provision in the newly passed legislation introduces an extreme THC cap of just 0.4mg per container—a move that industry leaders say would eliminate 95% of the legal hemp-derived market within a year. The goal of the new hemp ban is to eliminate the loopholes in the 2018 Farm Bill that make non-naturally occurring psychoactives (ie Delta 8 and Delta 10 THC that are derived from CBD Isolate) to be legal and unregulated.
That’s right: A single gummy with a low .5mg microdose of THC (derived from hemp) will be considered illegal under the new rule. However, if your state allows it, you can still visit a dispensary and get a high-dose 10mg THC gummy. In essence, you can still get high but will have to purchase therapeutic, non-psychoactive doses in single-serving packages.
We’re talking about thousands of businesses, hundreds of thousands of jobs, and billions in legitimate economic activity at risk—all because of a poorly written ban that completely misunderstands how honest hemp companies work while trying to root out Delta 8 and 10 products. Not to mention the unnecessary packaging waste for single-dose servings!

What’s Happening? What Is The Hemp Ban?
Congress just passed a funding bill with language that changes the definition of hemp under federal law. Instead of the previous standard—0.3% THC by dry weight—the new limit is based on total THC per container, capped at 0.4 milligrams.
For context:
- One MedRoots 25mg full-spectrum CBD gummy contains .44mg of hemp-derived THC. To remain compliant with the new law, we would have to reduce the THC content per gummy to .04mg and only sell them in single-serving packages. Instead of purchasing a 30-count bottle, you’d need to purchase 30 single-count gummies. Driving up the cost and packaging waste.
- Each Wellness Plus 100mg Full Spectrum CBD Suppository (our best-selling product) contains up to 1.8mg of THC, depending on the suppository's total weight, which is currently compliant with the 0.3% legal limit under the 2018 Farm Bill. We consider this a microdose; enough to provide relief and comfort, but not enough to inhibit cognitive functioning and prohibit everyday activities. It’s a win-win! This product will become illegal in November 2026 unless Congress passes common-sense legislation. No one is using six suppositories to get high; they’re going to a dispensary for that!
